Welcome to Link Lead, an SMS-based lead capture service operated by Side Nerd Apps ("Company," "we," "us," or "our"). By using Link Lead, you agree to these Terms of Service ("Terms"). Please read them carefully.

1. Acceptance of Terms

By accessing or using Link Lead, including texting our designated phone number, accessing our web dashboard, or using any related services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the service.

2. Description of Service

Link Lead is a text message-based lead capture tool that allows users to:

• Text notes about contacts and leads to a designated phone number
• Have AI extract structured data from natural language messages
• Sync lead data to CRM systems (HubSpot, Salesforce), Google Sheets, or our web dashboard
• Access lead reports and analytics

3. Eligibility

You must be at least 18 years old and have the legal capacity to enter into contracts to use Link Lead. By using the service, you represent that you meet these requirements.

4. Account and Access

4.1 Organization Accounts

Organizations subscribing to Link Lead are responsible for managing user access and ensuring all authorized users comply with these Terms.

4.2 Phone Number Verification

You must use a valid phone number to access Link Lead. You are responsible for all activity associated with your phone number.

5. Acceptable Use

You agree NOT to use Link Lead to:

• Collect or store data about individuals without their knowledge or in violation of applicable laws
• Send spam, unsolicited messages, or use the service for marketing purposes beyond lead capture
• Transmit illegal, harmful, threatening, abusive, or otherwise objectionable content
• Attempt to interfere with, compromise, or disrupt the service
• Violate any applicable local, state, national, or international law
• Collect sensitive personal information (SSN, financial account numbers, health information) unless specifically configured and agreed upon

6. Data and Privacy

6.1 Your Data

You retain ownership of all lead data you input into Link Lead. We process this data solely to provide the service as described.

6.2 Data Sharing

Lead data you capture is shared with your organization and synced to your configured integrations (CRM, Google Sheets, etc.). See our Privacy Policy for full details.

6.3 SMS Consent

By texting Link Lead, you consent to receive automated replies related to your lead capture activities. Reply STOP to opt out of messages. Standard messaging rates may apply.

7. Subscription and Payment

7.1 Pricing

Link Lead offers subscription plans as described on our website. Prices are subject to change with 30 days' notice.

7.2 Billing

Subscriptions are billed monthly. You authorize us to charge your payment method on file for all applicable fees.

7.3 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. No refunds are provided for partial months.

8. Intellectual Property

Link Lead, including its technology, AI models, branding, and documentation, is the property of Side Nerd Apps. You are granted a limited, non-exclusive license to use the service for its intended purpose during your subscription.

To the maximum extent permitted by law, Side Nerd Apps shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of Link Lead.

Our total liability for any claims arising from your use of Link Lead shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Side Nerd Apps, its officers, employees, and affiliates from any claims, damages, or expenses arising from your use of Link Lead, your violation of these Terms, or your violation of any third-party rights.

12. Modifications to Service and Terms

We reserve the right to modify or discontinue Link Lead at any time. We may update these Terms periodically. Continued use after changes constitutes acceptance of the new Terms.

13. Termination

We may suspend or terminate your access to Link Lead at our discretion if you violate these Terms or engage in conduct that we determine is harmful to the service or other users.

14. Governing Law

These Terms are governed by the laws of the State of South Carolina, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Charleston County, South Carolina.
